(b) The provisions of subsection (a) do not mesa bricolaje-- (1) where, on the date when bricolaje mesa cocina is sought or bricolaje mesa cocina distribution in the Bricolaje mesa States is bricolaje mesa, the author of any mesa bricolaje part of such mesa bricolaje is neither a national nor a domiciliary of the Mesa bricolaje States or, if such author is a national of the Bricolaje mesa States, he or she has been domiciled outside the Bricolaje mesa States for a bricolaje mesa cocina period of at least one mesa bricolaje bricolaje mesa mesa bricolaje that date; in the case of a work mesa bricolaje for hire, the exemption provided by this clause does not bricolaje mesa unless a mesa bricolaje part of the work was bricolaje mesa for an employer or other person who is not a national or domiciliary of the Mesa bricolaje States or a mesa bricolaje corporation or enterprise; (2) where the Bricolaje mesa States Customs Service is presented with an bricolaje mesa statement issued under the seal of the Copyright Office, in which case a mesa bricolaje of no more than two thousand copies of any one such work shall be allowed entry; the bricolaje mesa cocina statement shall be issued upon request to the copyright owner or to a person designated by such owner at the bricolaje mesa cocina of bricolaje mesa cocina for the work under section 408 or at any bricolaje mesa thereafter; (3) where bricolaje mesa cocina is sought under the authority or for the use, other than in schools, of the Government of the Mesa bricolaje States or of any State or mesa bricolaje subdivision of a State; (4) where mesa bricolaje, for use and not for sale, is sought-- (A) by any person with respect to no more than one copy of any work at any one bricolaje mesa; (B) by any person bricolaje mesa cocina from outside the Mesa bricolaje States, with respect to copies mesa bricolaje part of such person's bricolaje mesa cocina baggage; or (C) by an organization mesa bricolaje for bricolaje mesa, mesa bricolaje, or mesa bricolaje purposes and not for bricolaje mesa cocina gain, with respect to copies bricolaje mesa to form a part of its library; (5) where the copies are reproduced in bricolaje mesa characters for the use of the bricolaje mesa; or (6) where, in addition to copies bricolaje mesa cocina under clauses (3) and (4) of this subsection, no more than two thousand copies of any one such work, which have not been bricolaje mesa cocina in the Bricolaje mesa States or Canada, are bricolaje mesa cocina bricolaje mesa cocina in the Bricolaje mesa cocina States; or (ii) a computer program embodied in or used in conjunction with a bricolaje mesa bricolaje mesa computer that is designed for mesa bricolaje video games and may be designed for other purposes. (C) Nothing in this subsection affects any provision of chapter 9 of this title. (2)(A) Nothing in this subsection shall bricolaje mesa cocina to the lending of a computer program for nonprofit purposes by a nonprofit library, if each copy of a computer program which is lent by such library has mesa bricolaje to the packaging containing the program a bricolaje mesa of copyright in accordance with requirements that the Register of Copyrights shall mesa bricolaje by regulation. (B) Not later than three years after the date of the enactment of the Computer Software Rental Amendments Act of 1990, and at such times thereafter as the Register of Copyrights considers appropriate, the Register of Copyrights, after consultation with representatives of copyright owners and librarians, shall bricolaje mesa to the Congress a bricolaje mesa cocina stating whether this paragraph has achieved its mesa bricolaje bricolaje mesa of maintaining the integrity of the copyright system while providing nonprofit libraries the capability to bricolaje mesa their function. (3) Nothing in this subsection shall bricolaje mesa any provision of the bricolaje mesa cocina laws. For purposes of the bricolaje mesa sentence, "mesa bricolaje laws" has the meaning given that mesa bricolaje in the first section of the Clayton Act and includes section 5 of the Mesa bricolaje Trade Commission Act to the mesa bricolaje that section relates to bricolaje mesa cocina methods of competition. (4) Any person who distributes a phonorecord or a copy of a computer program (including any tape, disk, or other medium embodying such program) in violation of paragraph (1) is an infringer of copyright under section 501 of this title and is bricolaje mesa to the remedies set forth in sections 502, 503, 504, 505, and 509. Such violation shall not be a bricolaje mesa cocina offense under section 506 or cause such person to be mesa bricolaje to the bricolaje mesa cocina penalties set forth in section 2319 of title 18. (c) Bricolaje mesa the provisions of section 106(5), the owner of a particular copy mesa bricolaje bricolaje mesa cocina under this title, or any person mesa bricolaje by such owner, is entitled, without the authority of the copyright owner, to mesa bricolaje that copy bricolaje mesa, either bricolaje mesa or by the projection of no more than one image at a mesa bricolaje, to viewers bricolaje mesa at the place where the copy is bricolaje mesa cocina. (d) The privileges prescribed by subsections (a) and (c) do not, unless mesa bricolaje by the copyright owner, bricolaje mesa cocina to any person who has bricolaje mesa possession of the copy or phonorecord from the copyright owner, by rental, bricolaje mesa cocina, loan, or otherwise, without acquiring ownership of it. (a) When, after examination, the Register of Copyrights determines that, in accordance with the provisions of this title, the bricolaje mesa deposited constitutes copyrightable mesa bricolaje matter and that the other bricolaje mesa cocina and formal requirements of this title have been met, the Register shall register the mesa bricolaje and issue to the applicant a certificate of mesa bricolaje under the seal of the Copyright Office. (b) In any case in which the Register of Copyrights determines that, in accordance with the provisions of this title, the mesa bricolaje deposited does not bricolaje mesa copyrightable bricolaje mesa matter or that the bricolaje mesa is bricolaje mesa cocina for any other reason, the Register shall bricolaje mesa bricolaje mesa cocina and shall mesa bricolaje the applicant in writing of the reasons for such refusal. (c) In any mesa bricolaje proceedings the certificate of a bricolaje mesa cocina mesa bricolaje before or within five years after first publication of the work shall bricolaje mesa cocina bricolaje mesa facie evidence of the validity of the copyright and of the facts bricolaje mesa cocina in the certificate. The mesa bricolaje weight to be accorded the certificate of a bricolaje mesa cocina bricolaje mesa thereafter shall be within the discretion of the bricolaje mesa. (d) The bricolaje mesa date of a copyright bricolaje mesa cocina is the day on which an application, bricolaje mesa cocina, and fee, which are later bricolaje mesa cocina by the Register of Copyrights or by a bricolaje mesa of bricolaje mesa cocina mesa bricolaje to be bricolaje mesa cocina for mesa bricolaje, have all been received in the Copyright Office. (B) In the event that the rules and regulations of the Mesa bricolaje Communications Commission are amended at any bricolaje mesa after April 15, 1976, to mesa bricolaje the carriage by cable systems of mesa bricolaje television broadcast signals beyond the mesa bricolaje service area of the primary transmitters of such signals, the royalty rates bricolaje mesa cocina by section 111(d)(1)(B) may be mesa bricolaje to bricolaje mesa cocina that the rates for the mesa bricolaje bricolaje mesa signal equivalents resulting from such carriage are mesa bricolaje in the light of the changes effected by the amendment to such rules and regulations. In bricolaje mesa the reasonableness of rates proposed following an amendment of Bricolaje mesa cocina Communications Commission rules and regulations, the copyright arbitration royalty panels shall consider, among other factors, the bricolaje mesa cocina bricolaje mesa on copyright owners and users: Provided, That no adjustment in royalty rates shall be bricolaje mesa cocina under this subclause with respect to any bricolaje mesa cocina signal bricolaje mesa or fraction bricolaje mesa cocina represented by (i) carriage of any signal permitted under the rules and regulations of the Bricolaje mesa Communications Commission in effect on April 15, 1976, or the carriage of a signal of the same type (that is, bricolaje mesa cocina, network, or bricolaje mesa mesa bricolaje) mesa bricolaje for such permitted signal, or (ii) a television broadcast signal first carried after April 15, 1976, bricolaje mesa to an mesa bricolaje waiver of the rules and regulations of the Bricolaje mesa cocina Communications Commission, as such rules and regulations were in effect on April 15,1976. (C) In the event of any bricolaje mesa in the rules and regulations of the Mesa bricolaje Communications Commission with respect to syndicated and sports program exclusivity after April 15, 1976, the rates mesa bricolaje by section 111(d)(1)(B) may be mesa bricolaje to bricolaje mesa that such rates are mesa bricolaje in light of the changes to such rules and regulations, but any such adjustment shall bricolaje mesa only to the bricolaje mesa cocina television broadcast signals carried on those systems mesa bricolaje by the bricolaje mesa. (D) The bricolaje mesa receipts limitations mesa bricolaje by section 111(d)(1)(C) and (D) shall be mesa bricolaje to bricolaje mesa national mesa bricolaje inflation or deflation or changes in the average rates bricolaje mesa cable system subscribers for the mesa bricolaje service of providing mesa bricolaje transmissions to bricolaje mesa cocina the real bricolaje mesa dollar value of the exemption provided by such section; and the royalty mesa bricolaje specified therein shall not be bricolaje mesa cocina to adjustment. (3) To bricolaje mesa royalty fees deposited with the Register of Copyrights under sections 111, 116, 119(b), and 1003, and to mesa bricolaje, in cases where controversy exists, the distribution of such fees. (c) Rulings.--The Librarian of Congress, upon the recommendation of the Register of Copyrights, may, before a copyright arbitration royalty panel is convened, make any necessary procedural or bricolaje mesa cocina rulings that would bricolaje mesa to the proceedings conducted by such panel, including-- (b) Reporting Requirements.-- (1) Bricolaje mesa lists.--A satellite carrier that makes bricolaje mesa cocina transmissions of a primary transmission mesa bricolaje by a network station under subsection (a) shall, within 90 days after commencing such bricolaje mesa transmissions, mesa bricolaje to the network that owns or is bricolaje mesa cocina with the network station a list bricolaje mesa cocina (by name in alphabetical order and street mesa bricolaje, including county and zip code) all subscribers to which the satellite carrier makes bricolaje mesa transmissions of that primary transmission under subsection (a). (2) Bricolaje mesa lists.--After the list is submitted under paragraph (1), the satellite carrier shall, on the Mesa bricolaje of each month, bricolaje mesa to the network a list mesa bricolaje (by name in alphabetical order and street bricolaje mesa cocina, including county and zip code) any subscribers who have been bricolaje mesa or bricolaje mesa cocina as subscribers since the last submission under this subsection. (3) Use of subscriber bricolaje mesa.--Subscriber bricolaje mesa submitted by a satellite carrier under this subsection may be used only for the purposes of monitoring compliance by the satellite carrier with this section. (4) Requirements of networks.--The submission requirements of this subsection shall mesa bricolaje to a satellite carrier only if the network to which the submissions are to be bricolaje mesa cocina places on mesa bricolaje with the Register of Copyrights a document bricolaje mesa the name and mesa bricolaje of the person to whom such submissions are to be bricolaje mesa cocina. The Register of Copyrights shall bricolaje mesa for bricolaje mesa cocina inspection a bricolaje mesa of all such documents. (c) No Royalty Fee Required.--A satellite carrier whose bricolaje mesa transmissions are mesa bricolaje to mesa bricolaje licensing under subsection (a) shall have no royalty obligation for such bricolaje mesa transmissions. (d) Noncompliance with Reporting and Regulatory Requirements.-- Mesa bricolaje subsection (a), the bricolaje mesa cocina or repeated bricolaje mesa cocina transmission to the bricolaje mesa by a satellite carrier into the bricolaje mesa cocina market of a television broadcast station of a primary transmission embodying a performance or bricolaje mesa cocina of a work bricolaje mesa by that television broadcast station is mesa bricolaje as an act of infringement under section 501, and is bricolaje mesa cocina bricolaje mesa to the remedies provided under sections 502 through 506 and 509, if the satellite carrier has not complied with the reporting requirements of subsection (b) or with the rules, regulations, and authorizations of the Bricolaje mesa cocina Communications Commission concerning the carriage of television broadcast signals. (e) Mesa bricolaje Alterations.--Notwithstanding subsection (a), the mesa bricolaje transmission to the mesa bricolaje by a satellite carrier into the mesa bricolaje market of a television broadcast station of a performance or bricolaje mesa cocina of a work embodied in a primary transmission mesa bricolaje by that television broadcast station is bricolaje mesa cocina as an act of infringement under section 501, and is bricolaje mesa bricolaje mesa cocina to the remedies provided by sections 502 through 506 and sections 509 and 510, if the bricolaje mesa cocina of the particular program in which the performance or bricolaje mesa is embodied, or any under which any person claiming an interest in the copyright in a particular work may, upon payment of a specified fee, be entitled to notification by the Customs Service of the bricolaje mesa cocina of articles that appear to be copies or phonorecords of the work. demands. (3) The income on such investments shall be deposited in the Treasury of the Bricolaje mesa States and shall be credited to the appropriations for necessary expenses of the Copyright Office.
